“The submission of deponering is the wrong way to avoid being detained because many cases involving other figures have received deponering,” said OC Kaligis in Jakarta, Wednesday.

According to him, the case experienced by former KPK leaders Bibit and Chandra, who have been named suspects, was then deponered by the Attorney General’s Office on the orders of President Soesilo Bambang Yudhoyono (SBY).

The academic added that the case files for Bibit and Chandra had been declared complete (P-21) at that time to be submitted by the prosecutor’s office investigators to the court.

Likewise, the detention of Bibit and Chandra at that time was based on the consideration of Team 8 formed by President SBY so that it was finally carried out by the KPK, then they were released from detention.

He said another example of a suspect who also received deponering was former KPK officials Abraham Samad and Bambang Wijayanto who became suspects but were not detained.

The case of investigator Novel Baswedan also received deponering even though the court order to try Novel who shot dead a thief suspect in Bengkulu, while on duty at the Bengkulu Police whose case was ignored by Attorney General Prasetyo.

Deponering is the authority of the Attorney General to set aside a case for the public interest as regulated in Article 35 letter c of Law No. 16 of 2004 concerning the Indonesian Attorney General’s Office, as amended by Law No. 11 of 2021.
