“Indications of Structured, Systematic and Massive (TSM) violations, carried out by candidate pair (Paslon) number 02 as the Incumbent,” said OC Kaligis in Jakarta, Thursday.
Kaligis said that his client, Paslon number 01 for the Tanah Datar Pilkada, namely Richi Aprian (Regent) and Donny Karsont (Deputy Regent) that during the quiet period of the Defense easily mobilized and involved state administrators and used state facilities in campaign activities.
He said that there was a distribution of chickens to Saruaso residents on November 26, 2024, at that time it was the quiet period for the campaign.
Other indications of violations include providing free rice field plowing funds in several sub-districts during the quiet period on November 25-26, 2024.
As well as providing pick-up trucks and ambulances to Nagari Simabur which were received directly by the local village head.
“Even the incumbent provided a land grant for Nagari Pandai Sikek and an ambulance for Nagari Koto Baru, X Koto District,” said Kaligis, who is also a law professor at Manado State University, North Sulawesi.
He added that the meeting held by the Regional Secretary of Tanah Datar Regency at the Indo Jalito Building was the regent’s official residence by inviting all agencies but was carried out behind closed doors and did not invite the KPU, Bawaslu and the applicant even though the meeting discussed the regional elections.
In the minutes of the plenary recapitulation meeting, said Kaligis, none of the applicant’s witnesses as Candidate Pair 01 signed the minutes.
Bawaslu’s recommendation to hold a re-election at TPS 9 Sungayang, as stated in the Tanah Datar KPU letter No.475/PL.02.6-SD/1304/2024 dated November 29, 2024 so that the re-election at the TPS was not carried out.
Kaligis said that campaign facilities were not provided until close to the voting day, the toleration of Linmas attributes that resembled the attributes of Candidate Pair 02, the toleration of intimidation of a number of witnesses at the TPS.
With these various reasons, he said he was optimistic that the Constitutional Court judges would grant the request of Candidate Pair 01 for the Tanah Datar Regency Pilkada.
